Passenger Liability Waiver & Terms of Service Agreement

Effective Date: June 1, 2025

PLEASE READ THIS DOCUMENT CAREFULLY. YOUR PURCHASING AND/OR BOOKING A LEWES BUS TICKET, BOARDING, RIDING, AND/OR OTHERWISE USING ANY LEWES BUS SERVICES, OR BY ENTERING, ACCESSING OR USING ANY LEWES BUS RELATED FACILITIES, CONSTITUTES YOUR EXPRESS CONSENT, EQUIVALENT IN EFFECT TO A SIGNED WRITTEN AGREEMENT AND YOU AGREE TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN IN THIS PASSENGER LIABILITY WAIVER & TERMS OF SERVICE AGREEMENT. IF YOU ARE BOOKING ON BEHALF OF A MINOR OR ADULT PASSENGER, YOU REPRESENT THAT YOU HAVE THE REQUISITE LEGAL AUTHORITY TO ACCEPT THESE TERMS ON THEIR BEHALF. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING THE WAIVER OF CERTAIN LEGAL CLAIMS.

Definitions

“Lewes Bus” means Lewes Bus LLC and its authorized agents, employees, or contractors.

“Passenger” means any individual who purchases, reserves, or uses Lewes Bus services.

“Agreement” means this Passenger Liability Waiver & Terms of Service Agreement.

1. Acceptance of Terms

By purchasing a ticket, boarding, riding, or otherwise using any Lewes Bus services, or by entering, accessing, or using any related facilities, you expressly acknowledge and agree to be bound by the terms and conditions set forth in this Passenger Liability Waiver & Terms of Service Agreement (“Agreement”). Your acceptance during booking shall constitute your express consent, equivalent in effect to a signed written agreement.

By booking on behalf of other passengers, you affirm that you have communicated these terms to each passenger and that each passenger understands and consents to the Agreement and that you have the requisite legal authority to accept these terms on their behalf.

2. Assumption of Risk

I, the passenger, hereby acknowledge and agree that use of the transportation services provided by Lewes Bus LLC (“Lewes Bus”) and/or its premises involves inherent risks and hazards that may result in bodily injury, illness, death, property damage, or other loss. Such risks may include, but are not limited to, accidents, inclement weather, adverse road conditions, vehicular collisions, mechanical failure, passenger negligence, and unforeseen delays. I voluntarily elect to assume full responsibility for all risks, whether anticipated or unanticipated, associated with travel on Lewes Bus.

3. Release and Waiver of Liability

In consideration for receiving transportation services from Lewes Bus, I, on behalf of myself and my heirs, executors, administrators, assigns, and legal representatives, hereby unconditionally and irrevocably release, waive, and discharge Lewes Bus LLC and its officers, directors, owners, members, employees, independent contractors, agents, and affiliates (collectively, the “Released Parties”) from any and all claims, causes of action, liabilities, losses, or damages, whether known or unknown, foreseeable or unforeseeable, and including those arising from the ordinary negligence of the Released Parties resulting from or in any way related to my travel on Lewes Bus. This waiver expressly includes, but is not limited to, claims for personal injury, illness, death, property loss or damage, lost wages, COVID-19 exposure, and invasion of privacy. In no event shall Lewes Bus be liable for consequential or incidental damages for any loss, damage or delay directly or indirectly caused for any reason, including weather and/or traffic delays.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, suits, judgments, costs, attorney’s fees, expenses, and liabilities arising out of or resulting from (i) my conduct or actions during transit; (ii) my failure to adhere to posted policies, safety instructions, or applicable laws; or (iii) any breach of this Agreement.

5. Force Majeure

Lewes Bus shall not be liable for failure to perform or delays in performance due to circumstances beyond its reasonable control, including but not limited to traffic, acts of God, natural disasters, adverse weather, acts of terrorism, civil disturbances, labor disputes, government restrictions, public health emergencies, or mechanical failures.

6. Tickets

Booking Window & Last-Minute Reservations— Passengers may book online no later than twenty-four (24) hours before the scheduled departure time. For travel within 24 hours of departure, passengers must call Lewes Bus at (302) 470-6784 to check real-time seat availability and secure a reservation. Bookings made inside the 24-hour window are accepted strictly on a first-come/first-served basis and are not guaranteed; Lewes Bus reserves the right to decline last-minute bookings once vehicle assignments or schedules have been finalized.

Tickets are limited as endorsed and are non-transferable. The unauthorized resale of Lewes Bus tickets is strictly prohibited and will be prosecuted. No reservations are accepted unless expressly stated otherwise. Tickets are valid ONLY for the schedule, date, and time for which they were purchased. Lewes Bus is not responsible for lost or stolen tickets. 

You must provide Lewes Bus with a valid telephone number for operational purposes. Failure to be reachable may result in forfeiture of your ticket and associated costs without refund or compensation.

Passengers should be ready to present a government-issued photo ID if requested to confirm reservation ownership or verify age. Lewes Bus will visually inspect IDs when necessary and will not retain copies.

Be ready at your pickup point at least 10 minutes before your scheduled departure. Failure to meet this timeframe may result in delay or cancellation without refund.

7. Fares & Fees

Fares are valid ONLY for the schedule, date and time for which quoted. Discount fares are subject to date, time, and schedule restrictions. Fares may be subject to additional charges including taxes, fees, and carrier price differences. For non-refundable and advance purchase tickets, departure dates and times may be changed for a fee provided that advance purchase requirements are not violated (including holiday blackout restriction). Requests for exchanges must be made no later than 1 hour prior to the original travel departure time by contacting (302) 470-6784 or email [email protected]; otherwise, the ticket will be null and void. Modifications to bookings are subject to availability and within Lewes’ Bus reasonable control. Web fares can change. Peak and holiday travel blackouts may apply. Fares are payable in U.S. dollars only unless stated otherwise.

8. Cancellation Policy 

Lewes Bus requires reservations at least 60 minutes in advance to guarantee seating. Unless otherwise expressly stated as non-refundable on the ticket, our cancellation policy is as follows for unused one-way and round-trip tickets: 

  • Cancellations more than 48 hours before scheduled departure: a refund value equal to the full fare paid.
  • Cancellations between 24-48 hours before scheduled departure: 50% refund of the fare amount or full credit to be used within one (1) year of the cancellation date.
  • Cancellations less than 24 hours before scheduled departure: No refund will be issued; however, passengers may receive a full credit to be used within one (1) year of the cancellation date.
  • No-shows: Passengers who fail to appear for their scheduled departure without prior notification ("no-shows") at least one hour before their scheduled departure time forfeit their entire fare with no credit issued. 

To cancel or modify a reservation, passengers must contact Lewes Bus at (302) 470-6784 or email [email protected]. Modifications to bookings are subject to availability and within Lewes’ Bus reasonable control, and must be requested at least 1 hour prior to the scheduled departure. Alternatively, passengers may modify their booking up to the day before their scheduled departure by creating or logging into a TicketSpice account (our booking platform). A link to create an account can be found at the bottom of your confirmation email or on the booking page.

Operational Adjustments for Low-Demand Departures— Lewes Bus operates on a demand-responsive model. If, twenty-four (24) hours before a scheduled departure time, no confirmed reservations are on file, Lewes Bus may, at its sole discretion and without liability, cancel that departure and its corresponding return leg. Passengers seeking travel inside the 24-hour window must call Lewes Bus at (302) 470-6784 to confirm the run is still operating and to secure any remaining seats. Booking as early as possible is strongly recommended to guarantee service.

Credits issued under this policy are non-transferable and must be used for Lewes Bus transportation services within one (1) year of issuance. Lewes Bus reserves the right to modify this cancellation policy, in its sole discretion, without notice to passengers.

9. Service Limitations & Timeliness

Lewes Bus makes no representations or warranties regarding punctuality, schedule adherence, or timely arrival. I acknowledge that delays may occur due to factors outside the control of Lewes Bus, including but not limited to weather, traffic, road closures, and mechanical issues. Lewes Bus shall not be held liable for any missed connections, flights, appointments, or other time-sensitive engagements. Refunds or compensation shall not be issued in the event of delays, cancellations, or deviations in service beyond Lewes Bus’s reasonable control. You acknowledge that it is your sole responsibility to monitor such potential disruptions and adjust your travel plans accordingly, whether with Lewes Bus or any connecting transport provider, in line with this Agreement. 

With the exception of accommodations for disabled and elderly passengers, seating is on a first come/first served basis and is without regard to race, color, creed, national origin, or any other protected characteristic.

10. Passenger Conduct

I agree to behave in a lawful, respectful, and non-disruptive manner while on board Lewes Bus vehicles and premises, and will comply with all instructions given by Lewes Bus personnel. Lewes Bus reserves the right, in its sole discretion, to deny boarding or remove any passenger who is intoxicated, poses a safety risk to themselves, staff, or other passengers, or engages in unsafe, unlawful, abusive or otherwise objectionable behavior, or for the comfort of other passengers. Law enforcement may be contacted if necessary, and such removal does not entitle the passenger to a refund or compensation.

Smoking, vaping, and the possession or use of alcohol, controlled substances, or illegal drugs are strictly prohibited on board. Sealed alcoholic beverages are permitted in luggage only. Passengers must securely fasten seatbelts during travel as required by law.

11. Minors and Child Safety

Children under the age of eighteen (18) must be accompanied by a parent, legal guardian, or responsible adult over the age of eighteen (18). Guardians are solely responsible for ensuring that all minor passengers are seated in accordance with applicable child safety restraint laws, including those of the State of Delaware, the Commonwealth of Pennsylvania, and any federal transportation safety regulations. Lewes Bus disclaims all liability for failure to comply with such laws or regulations.

12. Animals and Service Animal Policy

Lewes Bus permits domestic pets to travel only under the following conditions and with advance notice:
• Dogs under twenty (20) pounds may be seated on a lap for a $25 fee.
• Dogs over twenty (20) pounds must travel in a secure crate and require the purchase of a separate fare.
• Cats must travel in an enclosed carrier ($25 per cat, maximum of two).

Passengers must notify Lewes Bus of pet travel at least 48 hours in advance to allow for approval and planning. All pet travel is contingent upon space availability and approval by Lewes Bus. In the interest of safety or allergy mitigation, Lewes Bus reserves the right to deny pet transport at its sole discretion. 

Pursuant to the Americans with Disabilities Act (ADA), trained service animals are permitted aboard Lewes Bus at no additional cost. Emotional support, therapy, and companion animals do not qualify as service animals under the ADA and are subject to the pet travel policy above. 13. Special Handling

Lewes Bus operates a 12 seater van. Seating is limited for all passengers. Lewes Bus is committed to assisting passengers with disabilities. We kindly request that passengers requiring accommodation for your trip contact a Lewes Bus representative at least 48 hours in advance at [email protected] or (302) 470-6784 so we can discuss travel assistance for customers with disabilities.

14. Baggage Policy

Lewes Bus expressly disclaims liability for any lost, damaged, or unattended baggage, as well as for any injuries caused by or resulting from shifting baggage during transit. Passengers may keep smaller personal items with them onboard, such as bags that can fit under the seat in front of them or comfortably on their lap. Larger luggage will be loaded into the vehicle’s rear trunk area by Lewes Bus staff or drivers.

While drivers will assist with loading and unloading baggage, Lewes Bus does not offer formal baggage check services and does not assume responsibility for the condition, safety, or security of items transported in the trunk. All baggage is carried at the passenger’s own risk.

Baggage must comply with Lewes Bus’s size and weight limits as outlined below. Certain items may be refused if deemed unsafe or excessive. Passengers are responsible for labeling all bags with their name and contact information and must promptly retrieve them upon arrival. Lewes Bus is not responsible for items left behind, and storage fees may apply for unclaimed baggage. Passengers needing special assistance with their luggage are encouraged to request help when booking or upon arrival.

Each fare-paying passenger is entitled to one (1) standard personal carry-on item (maximum weight: 25 lbs) and one (1) standard checked airport luggage (maximum weight: 50 lbs). See specific dimensions below:

Lewes Bus does not charge for large items onboard such as a stroller, car seat, etc. These items are allowed in addition to your standard baggage allowance. 

Additional luggage must be disclosed in advance and is subject to a $20 per-item surcharge, contingent on space availability. Bicycles, golf clubs, surfboards, and water skis are all considered oversized items. They must be packed in their applicable carrier, canvas bags, or other suitable containers, and securely fastened and are subject to additional fees. Oversized, undeclared, or excessive luggage may be refused at Lewes Bus’s discretion. Lewes Bus shall not be held liable for any loss or damage to any items transported on Lewes Bus, including, but not limited to, items that are improperly packed or fragile in nature, or contain valuable goods, electronic or electrical components, or other sensitive contents.

15. Prohibited Items

For safety reasons, passengers must not carry the following items in their baggage unless explicitly authorized by Lewes Bus in writing:

  • Loaded firearms or ammunition.
  • Corrosive materials (alkalis, acids, wet cell batteries, mercury).
  • Explosives (fireworks, flares, easily ignitable substances).
  • Flammable liquids and solids (matches, lighters, heater fuels, flammable aerosols).
  • Poisonous, toxic, or infectious substances.
  • Radioactive materials.
  • Compressed gases (flammable, non-flammable, poisonous, or deeply refrigerated).
  • Other dangerous or hazardous goods (including items with strong odors or offensive materials).

Passengers violating this policy may be denied service without refund and could face additional legal penalties.

16. Lost Property

Lewes Bus is not responsible for any personal belongings lost, misplaced, or left behind on its vehicles or premises. Found items will be retained for a maximum period of fourteen (14) calendar days. Return of items, if available, may be arranged at the passenger’s sole expense.

17. Medical Emergencies

Lewes Bus does not provide medical care or transport services for medical emergencies. In the event of a health-related incident, I authorize Lewes Bus personnel to contact emergency medical services (e.g., 911) as deemed necessary. I agree to assume full financial responsibility for any resulting medical treatment, transport, or related expenses.

18. COVID-19 Warning

Lewes Bus cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while utilizing its services or premises. It may not be possible to prevent against the presence of the disease and if you choose to utilize Lewes Bus services and/or enter onto its premises, you may be exposing yourself and your family to an increased risk of contracting or spreading COVID-19 by utilizing Lewes Bus services and/or entering its premises.

19. Photography & Media Release

Lewes Bus may photograph or record passengers in public areas of its vehicles for promotional or commercial use. By booking a ride, you consent to the potential use of your image or likeness. If you do not wish to be included in such materials, please email [email protected] prior to your trip or notify the driver prior to boarding. 

Opting out does not affect your ability to use Lewes Bus services.

20. In-Vehicle Recording Notice

Lewes Bus vehicles are equipped with video and audio recording devices for safety, service quality, and monitoring purposes. These recordings may capture activity inside and around the vehicle during your trip. By boarding a Lewes Bus vehicle, you acknowledge and consent to being recorded.

21. Data Privacy and Cybersecurity Disclaimer

Lewes Bus employs commercially reasonable measures to safeguard customer data. However, I acknowledge and accept that no system is entirely secure, and Lewes Bus does not guarantee protection against unauthorized access, breaches, or cyberattacks. Lewes Bus does not sell or share customer data with third parties for marketing purposes. In the event of a data breach, Lewes Bus will provide notice in accordance with applicable law. By utilizing Lewes Bus services, I accept these inherent risks.

22. E-mail Communications

By accepting these Terms, you consent to receiving transactional and service-related emails from Lewes Bus. Marketing communications, newsletters, and promotional content will only be sent if you have explicitly opted in. You may opt out of marketing emails at any time by following the unsubscribe link provided in those emails. Transactional emails related to your account or bookings may still be sent regardless of opt-in status.

23. Telephony and Call Recording

Lewes Bus uses a third-party provider, OpenPhone, to manage incoming calls and voicemail. Calls may be recorded for quality assurance, customer service, and training purposes. If you wish to discuss confidential matters, please let us know and we will return your call on a non-recorded line. Please do not provide sensitive personal data or medical information on the voicemail.

24. Wi-Fi Use Policy

Lewes Bus offers complimentary Wi-Fi onboard via a Verizon MiFi device. This service is provided as a courtesy and may be subject to interruptions or data limitations. Lewes Bus is not responsible for connectivity issues or any data charges incurred through your mobile provider.

We do not collect or monitor personal browsing activity or information. However, Verizon may collect limited technical data to maintain connectivity in accordance with their own terms of service. By using the Wi-Fi, you acknowledge and accept these conditions.

25. Courtesy & Device Use

For the comfort of all passengers, please use headphones when listening to music, watching videos, or making phone calls. Speakerphone use is not permitted, and conversations should be kept to a respectful volume. Lewes Bus reserves the right to request passengers reduce disruptive behavior. Repeated violations may result in removal from the vehicle without refund.

26. Soiling Fee

Passengers causing vehicle soiling will incur a fee up to $350. Soiling includes, but is not limited to, vomit, urine, feces, spilled food or beverages, excessive dirt or mud, or any condition that requires professional cleaning. Final assessment and charge are at the discretion of Lewes Bus staff.

27. Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware. As further described in Section 29 (Dispute Resolution), any legal action arising from or related to this Agreement must be brought exclusively in the state or federal courts located in Sussex County, Delaware.

28. Severability

If any provision or covenant of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions. The remainder of this Agreement shall remain in full force and effect, and the invalid provision shall be interpreted, if possible, in a manner consistent with the original intent.

29. Dispute Resolution

If any dispute arises out of these Terms and Conditions or any transaction made with Lewes Bus, you should first contact our Customer Service team at (302) 470-6784 or [email protected]. We will acknowledge your complaint as soon as reasonably possible and will make every effort to resolve the matter promptly and fairly.

Lewes Bus will use reasonable efforts to consult and negotiate in good faith to reach a mutually acceptable resolution.

In the unlikely event that we are unable to resolve the matter informally, either party may initiate mediation or arbitration. To begin this process, the initiating party must provide written notice to the other party requesting mediation or arbitration.

If the dispute remains unresolved following mediation or arbitration, any legal action must be brought exclusively in the state or federal courts located in Sussex County, Delaware, and both parties consent to the jurisdiction and venue of those courts.

30. Waiver

If Lewes Bus delays or fails to enforce any provision of this Agreement, that shall not be deemed a waiver of its right to enforce such provision at a later time.

31. Entire Agreement

This Agreement, along with any documents incorporated by reference (including information provided on the Lewes Bus website at www.lewesbus.com), constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, terms, conditions, or arrangements—whether written or oral—relating to its subject matter.

32. Acknowledgment of Terms

By proceeding with your booking, by boarding, riding, or otherwise using any Lewes Bus services, or by accessing or using any related facilities, you hereby confirm that you have read, understand, and agree to be legally bound by these Terms and Conditions. If you are booking on behalf of a minor or adult passenger, you represent that you have the requisite legal authority to accept these terms on their behalf.

YOU HEREBY CONFIRM THAT YOU HAVE CAREFULLY READ, FULLY UNDERSTAND, AND VOLUNTARILY AGREE TO THE FOREGOING TERMS AND CONDITIONS, AND THAT YOU ARE LEGALLY AUTHORIZED TO DO SO.

YOU UNDERSTAND THAT THIS AGREEMENT CONSTITUTES A LEGALLY BINDING WAIVER AND RELEASE OF LIABILITY, AND THAT YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. IF ACCEPTING ON BEHALF OF A MINOR OR ADULT INDIVIDUAL, YOU HEREBY CERTIFY THAT YOU HAVE THE LEGAL AUTHORITY TO DO SO AND ACCEPT FULL RESPONSIBILITY FOR THE SAME.
