This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Lewes Bus LLC Service (“Service”) and tells You about Your privacy rights and how the law protects You.

Definitions

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Analytics Provider means any third-party Service Provider engaged by the Company to collect, monitor, or analyze Usage Data for the purpose of understanding how the Service is used, measuring performance, or improving the Website and related services.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Lewes Bus LLC.
  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

We will only collect this information with your explicit consent, and you are not required to provide it to use our basic services.
  • Communications Data: Information you provide when you contact us for customer service or other inquiries.
  • Device Information: We may collect your IP address for security purposes and to ensure the proper functioning of our website and services.
  • Identity Verification Information: When requested for verification purposes, we may visually inspect government-issued photo IDs to confirm reservation ownership or verify age. We do not retain copies or store ID information from these visual inspections

Note on Payments: Lewes Bus does not directly collect or store your credit card or payment details. All transactions are securely processed by TicketSpice (operated by Webconnex), our third-party booking and payment platform. How We Use Your Information

We use your personal data for the following purposes:

  • To Provide Services: To process and confirm your bookings, manage your account, and provide you with the services you request.
  • To Communicate With You: To send you trip updates, respond to your customer service inquiries, and provide other important information related to your use of our services.
  • To Improve Our Services: To understand how our services are used and to make improvements to our website and service experience. This is based on aggregated, de-identified data or direct feedback, not individual tracking for profiling.
  • For Marketing Communications (with your consent): To send occasional promotional messages about our services or special offers, but only if you have explicitly opted in to receive such communications. You can opt-out at any time.
  • For Legal and Security Purposes: To comply with applicable laws, regulations, and legal processes, and to protect the security and integrity of our services and the rights of Lewes Bus and our users.

Text Messaging & SMS Opt-In

When you provide your phone number and explicitly opt in to SMS communications during the booking process, you consent to receive text messages from Lewes Bus. These messages may include:

  • Ride confirmations and updates.
  • Replies to your customer service inquiries.
  • Occasional service notices or time-sensitive promotional offers (only if you have separately consented to promotional messages).

SMS delivery and opt-in services are handled via TicketSpice (Webconnex). Your phone number is not sold or shared for third-party marketing unrelated to Lewes Bus services.

We may use Cookies and similar tracking technologies to track activity on our Website and to improve and analyze our Service. Who We Share Data With

We only share your personal data with trusted third-party service providers who assist us in operating Lewes Bus and providing services to you. These include:

  • TicketSpice / Webconnex: For secure bookings, SMS communications related to bookings, and payment processing. All payment transactions are processed by TicketSpice (operated by Webconnex), which maintains PCI-DSS compliance and follows industry-standard security protocols, including encryption, access control, and secure data centers.   • OpenPhone: For managing telephone communications and voicemail. OpenPhone may collect Usage Data and device information related to your interactions with our calls or messages (e.g., IP address, call duration, device type). Calls may be recorded for quality assurance, training, and customer service purposes. OpenPhone is SOC 2 certified and follows industry-standard security and privacy practices. We require these service providers to protect your personal data and only use it for the purposes for which it was disclosed.

We do not sell your personal data to third parties. For the purposes of this policy and in alignment with the DPDPA, "sell" means the exchange of personal data for monetary or other valuable consideration.

We may share anonymized or aggregate Usage Data with trusted analytics providers (such as Google Analytics) for the purpose of monitoring traffic, improving our website, and evaluating the effectiveness of our advertising campaigns.

Delete Your Personal Data

You have the right to delete, or request that we assist in deleting, the Personal Data we have collected about you.

If you have an account, you may delete certain information directly by logging in and managing your settings. You may also contact us at any time to request access to, correction of, or deletion of your personal data.

Please note that we may retain certain information when required by law or when we have another lawful basis to do so.

Your information, including Personal Data, may be processed and stored in locations outside of your state or local jurisdiction. This includes data processed by third-party service providers we use to deliver our services (such as booking, payments, communications, and analytics).

Lewes Bus takes reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Policy, regardless of where it is processed.

Disclosure of Your Personal Data

  • Business Transactions: If Lewes Bus is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred as part of that transaction. We will provide notice if your Personal Data becomes subject to a different privacy policy as a result of such a transfer.

  • Right to Delete: To delete personal data provided by or obtained about you.
  • Right to Obtain a Copy (Portability): To obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format.
  • Right to Know Categories of Third Parties: To obtain a list of the categories of third parties to which we have disclosed your personal data.
  • Right to Opt-Out:
    • You have the right to opt out of the sale of personal data and targeted advertising. While Lewes Bus does not currently sell personal data or engage in targeted advertising, you may exercise this right if our practices change in the future.
    • You also have the right to opt out of profiling in furtherance of solely automated decisions that produce legal or similarly significant effects. Lewes Bus does not currently engage in such profiling.

Other U.S. State Privacy Rights
 Many US states provide (now or in the future) their state residents with rights to:

  • Data portability.
  • Opt-out of personal data processing for:
    • targeted advertising (excluding Iowa);

    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).

Vehicle Cameras and Safety Monitoring

For the safety of our passengers, drivers, and vehicles, Lewes Bus uses in-vehicle technology provided by Azuga. Our vehicles are equipped with video and audio recording devices that may capture activity inside and around the vehicle during your trip. For more information, please review Azuga's Privacy Policy.

These recordings are used for safety monitoring, insurance purposes, and service quality reviews. Recordings are securely stored and accessed only by authorized personnel or as required by law (e.g., during an investigation or legal proceeding). Azuga retains video footage for up to 12 months, but archived footage may be retrievable for up to 5 years from the date of recording upon request and subject to a fee.

By using Lewes Bus services and boarding one of our vehicles, you acknowledge and consent to being recorded.

Data Security

We implement and maintain reasonable administrative, technical, and physical data security practices to protect the confidentiality, integrity, and accessibility of your personal information from unauthorized access, use, or disclosure.

However, no system or method of transmission over the Internet, or method of electronic storage, is 100% secure, and we cannot guarantee absolute protection.

If we become aware of a data breach involving your personal information, we will notify you in accordance with applicable laws.

Data Retention

We will only retain your personal information for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third-party’s site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Children’s Privacy

Our services are not directed to children under the age of 13, and we do not knowingly collect personal data from children under 13 without verifiable parental consent, in accordance with the Children's Online Privacy Protection Act (COPPA) and the DPDPA. If you are a parent or guardian and you are aware that you child has provided us with personal data, please contact us. If we learn that we have collected personal data from a child under 13 without such consent, we will take steps to delete that information promptly.

For minors aged 13 to 17, while our services may be used by them, we do not sell their personal data or process it for targeted advertising. If our practices were to change, we would obtain the minor's explicit opt-in consent for such activities as required by the DPDPA.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. When we make changes, we will revise the "Effective Date" at the top of this policy. We encourage you to review this policy periodically to stay informed about how we are protecting your information.
